Repair or replace defective parts of electric scooter and pay Rs 10,000 to buyer, Chandigarh dealer & company told | Chandigarh News - The Indian Express

The District Consumer Disputes Redressal Commission of Chandigarh has directed an electric scooter dealership and its manufacturing company to repair/replace defective parts of an electric scooter and pay Rs 10,000 as compensation to a city woman.

Anita Sood of Chandigarh said that on March 29, 2023, a representative of Go Green Bikes Private Limited, Chandigarh, explained the features of an electric scooter manufactured by Hero Electric Vehicle Private Limited and insisted she purchase the scooter.

On the assurances of Go Green Bikes representative, the complainant purchased a Hero Electric Photon LP (an electric scooter) for Rs 93,000 from Go Green Bikes (dealership) on March 29, 2023, which included the price of the electric scooter, insurance and registration charges, etc.

It is alleged that at the time of delivery of the electric scooter, the dealer had not provided an internal dicky cover and put a jute bag to cover the battery and that immediately after the purchase, the electric scooter started giving problems as it started running automatically, which means no speed control by the brakes and whenever the complainant reported the matter to the dealer, the scooter’s defects were removed by it but after repeated requests by the complainant.

The complainant said the motor of the electric scooter stopped working in December 2023 and she visited the dealer’s workshop on December 15, 2023. Despite inspecting the electric scooter, the dealer did not remove the defect, thus the complainant sought a refund of the price of the electric scooter along with compensation.

The complainant alleged that the electric scooter had a manufacturing defect. “Thus, as per law, the dealer and the company are bound to repair/replace the defective parts. In case, if the repair is not possible, replace the defective scooter with a new one,” the complainant said.

On the complaint, Go Green Bikes Private Limited and Hero Electric Vehicle Private Limited, were properly served notice and when they did not turn up before this Commission, despite proper service, they were proceeded against ex-parte on July 1, 2024.

The Commission on hearing the matter said, “Since the electric scooter was under warranty when the defect occurred, it is the obligation of the dealer and the company to repair or replace the defective parts of the electric scooter instead of replacing the scooter or refund its price to the complainant, especially when the defect of motor occurred after nine months of purchase of the electric scooter and was not noticed before that. Thus, the dealership and company are only liable to repair/replace the defective part of the electric scooter and thereby make the same functional.”

The Commission, thus, directed Go Green Bikes Private Limited and Hero Electric Vehicle Private Limited to repair/replace the defective part, which is the motor of the electric scooter free of cost, and make it functional, and to pay a lump sum amount of Rs 10,000 to the complainant as compensation for causing mental agony and harassment.
